With or Without Colour
In the column to the left, we briefly discuss the question of registering the brand name, versus the logo.
Another, very similar question, is often pondered by companies who have decided to register their logo.
They then question whether to register it in colour, as it is generally used, or to register it without colour (i.e. in black and white).
The situation here is very similar to the one discussed in the previous column. Ideally, from a legal perspective, it is good to protect the logo both with, and without, colour. Each registration can provide different emphasis to the protection of the logo.
Where this is not possible in the first instance, for budgetary reasons, we will explain things to you, so that you can make an informed decision.

To Register a Name or a Logo...?
At Reif Marks, we are often asked whether to register the name of the brand, or else the logo used in connection with the brand.
Simply put, from a purely legal perspective, it is beneficial to register two trademarks: one for the brand name; and another for the logo. In this way, each of the brand name and the logo will be better protected. Of course, this increases costs.
If limited budgets do not permit the filing of two applications, then a tough decision often has to be made - whether to first file the name, or the logo. Reif Marks will help you with this decision, which will be influenced by the particular circumstances of your case, but ultimately it will be your call...
Of course, you can always file the other application later on, when your budget allows, as long as it is still available...
